These Terms of Use (“Terms”) govern your access to and use of The Wave website at betonthewave.com (the “Site”), our mobile applications (the “Apps”), and any related services, content, features, memberships, and communities (collectively, the “Services”). The Services are operated by Molly Grantham Media LLC (“Company,” “we,” “us,” “our”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1) Eligibility
You must be at least 13 years old (or older if required by applicable law) to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2) Accounts and Membership
To access certain features (including members-only profiles and community areas), you may need to create an account and purchase a membership.
You agree to:
- provide accurate account information,
- keep your login credentials confidential,
- promptly notify us of unauthorized access.
You are responsible for activity that occurs under your account.
3) Subscriptions, Billing, and Payments (Stripe)
Membership subscriptions and any other paid purchases are processed through Stripe.
- Billing authorization: By starting a subscription, you authorize us (through Stripe) to charge your selected payment method on a recurring basis until you cancel.
- Renewals: Subscriptions renew automatically unless canceled before the next billing date.
- Taxes: Where applicable, taxes may be added.
- Failed payments: If a payment fails, we may retry charges and may suspend access until payment is successfully processed.
- Price changes: We may change pricing or plans with notice as required by law; changes typically apply at the next renewal.
4) Cancellation and Refunds
- Cancellation: You may cancel your subscription at any time through your account settings or by contacting us at thewave@mollygrantham.com. Cancellation stops future renewals; you will generally retain access through the end of the current billing period.
- Refunds: Unless required by law, payments are non-refundable and we do not provide prorated refunds for partial subscription periods. If you believe you were billed in error, contact us.
5) Community Guidelines and Acceptable Use
You agree not to:
- violate any law or regulation,
- harass, threaten, defame, or abuse others,
- post, upload, publish, transmit, or otherwise share content that:
- is hateful, discriminatory, harassing, or abusive;
- is pornographic, sexually explicit, sexually exploitative, or intended to be sexually gratifying;
- contains nudity, including explicit or non-explicit depictions of genitals, breasts, or buttocks, except where expressly permitted by us in a clearly educational, medical, or safety-related context;
- depicts, promotes, glorifies, or sensationalizes graphic violence, gore, serious physical injury, or real-world death;
- depicts or shares real-world graphic violence, gore, or bodily injury, including in photos or videos of accidents, assaults, war, abuse, or animal cruelty;
- exploits or sensationalizes tragic, violent, or disturbing real-world events;
- post content that infringes someone else’s rights (including intellectual property or privacy),
- spam, solicit, or run promotions without our permission,
- attempt to gain unauthorized access to accounts or systems,
- interfere with or disrupt the Services (including by introducing malware),
- scrape, crawl, or use automated means to access the Services except as permitted by us.
We may remove content and/or suspend or terminate accounts for violations. We reserve the right to determine, in our sole discretion, whether content is prohibited, graphic, sexually explicit, exploitative, or otherwise objectionable under these Terms.
6) User-Generated Content (UGC)
The Services may allow you to post, upload, submit, or otherwise make available content, including text, images, and other materials (“User Content”).
You represent and warrant that:
- you own or have the necessary rights to submit your User Content,
- your User Content does not violate law or the rights of others,
- your User Content complies with these Terms.
License you grant to us: You grant Company a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting and display), publish, display, and distribute your User Content solely to operate, improve, and provide the Services and to enforce these Terms. This includes displaying your User Content to other members in members-only areas.
We may review, restrict, remove, or refuse to publish User Content at any time if we believe it violates these Terms, creates risk for users, or may violate platform or app store policies.
Removal: You can delete certain User Content where the feature exists. We may retain copies as needed for backups, legal compliance, dispute resolution, and enforcement.
7) Member Profiles (Members-Only)
Member profiles and community features are intended for logged-in members only. You agree not to share members-only content outside the Services in a way that violates these Terms, others’ privacy rights, or any confidentiality expectations communicated within the community.
8) Intellectual Property
The Services—including the Site, Apps, design, text, graphics, logos, and other content provided by us (“Company Content”)—are owned by or licensed to Company and are protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use (unless we expressly agree otherwise).
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Company Content except as permitted by law or with our written consent.
9) Third-Party Services and Links
The Services may integrate with or link to third-party services (for example, Stripe for payments and Google Analytics for analytics). We do not control third parties and are not responsible for their content, policies, or practices. Your use of third-party services is subject to their terms and policies.
10) Privacy
Your use of the Services is also governed by our Privacy Policy (posted on the Site). By using the Services, you consent to the collection and use of information as described in the Privacy Policy.
11) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Services will be uninterrupted, error-free, secure, or that content will be accurate or complete.
No professional advice: Any information provided through the Services is for general informational purposes only and is not legal, medical, financial, or other professional advice.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO COMPANY FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF YOU HAVE NOT PAID ANY AMOUNTS), WHICHEVER IS GREATER.
(Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.)
13) Indemnification
You agree to indemnify and hold harmless Company from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:
- your use of the Services,
- your User Content,
- your violation of these Terms,
- your violation of any rights of another person or entity.
14) Termination
We may suspend or terminate your access to the Services at any time if we believe you violated these Terms or if necessary to protect the Services, users, or Company.
You may stop using the Services at any time. Termination does not affect provisions that by their nature should survive (including Sections on intellectual property, disclaimers, limitation of liability, and indemnification).
15) Changes to the Services or Terms
We may update the Services and these Terms from time to time. If we make material changes, we will post updated Terms and update the “Effective date.” Continued use of the Services after changes means you accept the updated Terms.
16) Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of laws principles.
